This Privacy Policy (“Policy”) describes how F&S Media IP LLC and its affiliates, including F&S IP Owner LLC (collectively, “F&S,” “we,” “us,” or “our”), collect, use, disclose, and otherwise process information about you in connection with your access to and use of www.fieldandstream.com (the “Website”), including any online shop, membership program, streaming video content, editorial content, and related digital media services (collectively, the “Services”).

for any changes. Your continued use of the Website after such changes have been made constitutes acceptance

of those changes. You will be directed to the applicable Policy upon your creation of an account which allows you

access to any restricted portion of the Website.

 

Collection of Information.

 

  1. Information that You Provide. F&S collects any information that you voluntarily provide, including when you submit information requesting a demonstration, joining the e-mail list, or when you use the Services available through the Website. Information that you may provide may include your email address, name, phone number, location, online social accounts, etc. F&S may also collect information that you provide by electronic mail, telephone or other means.
  2. Customer Service Communications. We may monitor or record communications (such as customer service calls or support interactions) for quality assurance, training, and operational purposes, to the extent permitted by applicable law.
  3. Automatically Collected Information. F&S may automatically collect certain technical information from your computer or mobile device when you use the Website, such as your Internet Protocol address, your web browser type and version, the name and version of your operating system, the pages you view on the Website, the pages you view immediately before and after you access the Website, and the search terms you enter on the Website. This information allows F&S to recognize you and personalize your experience if you return to the Website using the same computer or mobile device, and to improve the Website and the Services.
  4. Anonymous or Passive Website Use. You may visit portions of the Website without providing Personal Information. In such cases, we may collect limited information automatically, such as device type, browser type, and general usage data, which does not directly identify you.
  5. Information about Legal and Other Materials. In addition, F&S may collect technical information from your computer or mobile device concerning your receipt of communications, access to materials and approval or execution of contracts, consents or other statements or agreements by means of the Website, including the Website’s Terms and Conditions and this Policy.

You can disable cookies in your browser settings, but doing so may affect the functionality of the Website. We and our third-party partners may collect information about your activities across websites, devices, and services over time for purposes of analytics, personalization, and advertising. This may include the use of cookies, pixels, SDKs, and similar technologies.
  8. Media and Video Viewing Information. F&S may collect information about your interaction with video, audio, and other media content available through the Services, including content viewed, viewing duration, interaction with media players, and related device and session data. To the extent that any applicable law (including the Video Privacy Protection Act, 18 U.S.C. § 2710 (“VPPA”)) applies, F&S does not knowingly disclose information that identifies a specific individual as having requested or obtained specific video materials or services, except (i) with your prior consent, (ii) as permitted by applicable law, or (iii) in a manner that does not identify you personally. F&S does not knowingly disclose information that identifies a specific individual as having viewed specific video content to third-party advertising or analytics providers without appropriate consent where required by law. Where required by applicable law, including the VPPA, F&S will obtain any consent required for the collection, use, or disclosure of video‑viewing information through an appropriate consent mechanism. Where required, we will obtain separate consent prior to any disclosure of video viewing information that identifies you personally. F&S does not knowingly use or disclose video viewing information for purposes of targeted advertising in a manner that identifies you personally without appropriate consent where required by law.
  9. Content Personalization and Media Delivery. To provide, personalize, and improve editorial, video, and other media content, including recommending content based on your interests and measuring engagement.

 

Use and Disclosure of Information. F&S may collect, use, share, and otherwise process your personal information for a number of purposes, including, but not limited to:

  1. Accessing the Website and Providing and Improving the Services. F&S uses your Personal Information to provide you with the Services, or products, services or information related to the Website:
    1. To administer or otherwise carry out our obligations in relation to any agreement to which we are a party;
    2. To assist you in completing a transaction or order;
    3. To prepare and process invoices and payments;
    4. To respond to queries or requests and to provide support;
    5. To create, manage and audit our customer accounts;

However, we may “share” Personal Information with third parties for purposes of cross-context behavioral advertising or targeted advertising as defined under applicable law. You have the right to ask F&S not to process your Personal Information for marketing purposes. F&S will usually inform you (before collecting your information) if it intends to use your information for such purposes or if it intends to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms F&S uses to collect your information. You may opt out of marketing communications and certain data uses at any time by following the instructions provided in communications or by contacting us.

F&S may use your Personal Information for safety and security purposes, including sharing of your information for such purposes, when it is necessary to pursue F&S’s legitimate interests in ensuring the security of the Website and Services, including detecting, preventing and responding to fraud, intellectual property infringement, violations of the Website’s Terms and Conditions, violations of law or other misuse of the Website; and when F&S believes in good faith that disclosure is necessary (A) to protect F&S’s rights or other users of the Website, the integrity of the Website, or your safety or the safety of others, or (B) to detect, prevent or respond to fraud, intellectual property infringement, violations of the Website’s Terms and Conditions, violations of law or other misuse of the Website. While we implement reasonable safeguards, no system can be completely secure. F&S is not responsible for unauthorized access to information where such access is beyond our reasonable control.
  5. Account Security. If you believe your account credentials or payment information have been lost, stolen, or compromised, you should contact us immediately so we can take appropriate measures.
  6. Service Providers. F&S engages third-party service providers (such as hosting providers and analytics and security providers) to assist in operating and marketing the Services. F&S may also use ecommerce platform providers, payment processors, fraud‑prevention providers, shipping and fulfillment partners, and similar service providers to support purchases, order processing, and customer communications in connection with the Services. F&S’s engagement of third-party service providers is often necessary for F&S to provide the Services to you, particularly where such third-party service providers ensure that the Website and Services are operating and secure. In other cases, F&S has a legitimate interest in third-party service providers that can help improve the Website and the Service.
  7. F&S may share Personal Information with its affiliates and related entities for purposes consistent with this Policy.
  8. Other Disclosure. F&S may disclose Personal Information about you to others: (a) if F&S has your valid consent to do so; (b) to comply with a valid subpoena, legal order, court order, legal process, or other legal obligation; (c) to enforce any of the F&S terms and conditions or policies; or (d) as necessary to resolve disputes, pursue available legal remedies or defend legal claims. In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to appropriate safeguards. Notwithstanding the foregoing, F&S does not disclose Personal Information in a manner that would identify you as having viewed or interacted with specific video content, except as permitted by applicable law or with your consent.

 

Purchases and E-Commerce. When you make a purchase through the Website, we collect information necessary to process and fulfill your order, including your name, billing and shipping address, payment details, and transaction history. Payment processing may be handled by third-party payment processors, and order fulfillment may be performed by third-party partners. Affiliate and Third-Party Retailers. The Website may include links to third-party retailers and affiliate partners (including marketplaces such as Amazon). The Website and its operators maintain administrative, technical and physical safeguards designed to protect the information collected through the Website; however, no information or communication Website can be 100% secure, so F&S cannot guarantee the absolute security of your information. In addition, F&S is not responsible for the security of information that you transmit to the Website over networks that F&S does not control, including the Internet and wireless networks.

F&S uses Cookies for the following purposes: (i) to enable and support security features, prevent fraud, and protect your data from unauthorized access; (ii) to enable features and help us provide you with personalized content, and (iii) to analyze how you use the Website and to monitor site performance. These Cookies help us to identify and fix errors, understand and improve services, research and test out different features, and monitor how you reached the Website.

If you are a resident of the European Economic Area or the United Kingdom, F&S will process your Personal Information in compliance with the EU General Data Protection Regulation (“GDPR”).

 

For information submitted using the Website, F&S Media IP LLC is the data controller, as defined under GDPR. In accordance with GDPR, where F&S processes your Personal Information as a data controller, in certain circumstances you will have certain rights, which may include the following:

  • right to erasure;
  • right of restriction of processing;
  • right to data portability;
  • right to object;
  • right to withdraw data protection consent; and
  • right to lodge a complaint with a supervisory authority.

 

Notice to California Residents: California Consumer Privacy Act

As of January 1, 2020, verified California residents have the right to:

 

  1. request and receive disclosure of our personal information collection practices during the prior 12 months, including the categories of personal information we collect, the categories of sources of such information, our business purpose for collecting or sharing such information, and the categories of third parties with whom we share such information;
  2. request and receive a copy of the personal information we have collected about them during the prior 12 months;
  3. request and receive disclosure of our information sharing practices during the prior 12 months, including a list of the categories of personal information sold with the category of third-party recipients and a list of the categories of personal information that we disclosed for a business purpose;

We may request that you submit a signed statement under penalty of perjury that you are the individual you claim to be. We will acknowledge receipt of your request within 10 days and will endeavor to respond within forty-five days of receipt of your request, but if we require more time (up to an additional forty-five days) we will notify you of our need for additional time. For requests that we not sell your information, we will comply with your request within 15 days. We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm that the personal information relates to you.

 

You may make a request for disclosure of our information collection practices, the information we collected about you, or our sharing practices up to twice within a 12-month period. You may make a request that we not sell information or for deletion of your information at any time.

 

For requests for a copy of the personal information we have collected during the 12 months prior to your request, we will endeavor to provide the information in a format that is readily useable, including by mailing you a paper copy or providing an electronic copy to your registered account, if you have registered an account with us.

For requests for deletion of your information, please understand that California law permits us to retain certain information and not to delete it under certain circumstances. By way of example, we are not required to comply with a request to delete information if the information is necessary for us to complete a transaction for you or otherwise perform a contract; to detect, protect against, or prosecute security incidents, fraud or illegal activity; to use the information only internally in ways reasonably aligned with your expectations as our customer (such as maintaining sales records), and to comply with legal obligations. If we receive such a request from you, we will notify any service providers we have engaged to delete your information as well.

We will not discriminate against you as a result of your exercise of any of these rights.

 

Selling Information. We do not sell Personal Information for monetary consideration, but may share Personal Information for targeted advertising purposes.  If, in the future, we enter into arrangements that fall within the definition of a “sale” under the CCPA, we will update this privacy policy and our compliance with the CCPA.

Using an Authorized Agent. You may submit a request through someone holding a formal Power of Attorney. Otherwise, you may submit a request using an authorized agent only if (1) you provide the authorized agent with written permission to make a request and (2) you verify your own identity directly with us. We will require the agent to submit proof to us that they have been authorized to make requests on your behalf.

 

You have the right to opt out of the “sale” or “sharing” of your Personal Information for targeted advertising purposes.You may exercise this right by using the “Your Privacy Choices” or  “Do Not Sell or Share My Personal Information” link or mechanism made available on the Website, where required by applicable law.

F&S has no control over, and is not responsible for any content, products or services offered by or found on third party sites. Links to third party sites do not constitute an assumption of liability, sponsorship, endorsement, or approval of these sites or the content contained in these sites. You acknowledge and agree that F&S is not responsible for the collection and use of your information by such websites that are not under F&S’s control. F&S encourages you to review the privacy policies of each website you visit. The terms “third-party”, “third party”, “third parties” and similar terms shall mean another party other than F&S Media IP LLC and its affiliates.

User Content. If you participate in forums, comments, or other interactive features of the Website, any information you submit may be publicly available. You should not submit information you wish to keep private. F&S is not responsible for how others may use such information.

Embedded Content and Third-Party Media. The Website may include embedded content (such as videos, advertisements, or social media features) provided by third parties. These third parties may collect information about your interactions with such content in accordance with their own privacy policies. F&S does not control these third parties’ data practices and is not responsible for their collection or use of your information.

 

 

Children’s Information. The Website is not directed to, nor does F&S knowingly collect information from, children under the age of 13. Other Agreements.
